The following are the particular terms and conditions (the "Particular Terms and Conditions") governing the service known as "Receive remittances from the USA," which allows the User to receive payments from individuals operating within the Cash App system in the United States. These must be read, understood, and accepted by those who use the provided service (the "Service").
Acceptance
By accepting the Particular Terms and Conditions, you agree to comply with each of the Particular Terms and Conditions, the General Terms and Conditions, and the Privacy Policy prior to using the Service. All capitalized terms not defined herein shall have the meaning assigned to them in the General Terms and Conditions.
THE USE OF THE SERVICES CONSTITUTES SUFFICIENT PROOF OF THE USER'S ACCEPTANCE OF THESE GENERAL TERMS, THE PRIVACY POLICY, AND ALL OTHER DOCUMENTS GOVERNING THE PRODUCTS AND SERVICES OFFERED TO USERS.
Any User who does not wish to accept these ParticularTerms and Conditions must refrain from using the Service.
1. What is Cash App?
Cash App is a mobile payment application that allows users in the United States to send and receive payments digitally. Cash App is widely used in the U.S. market and offers features for peer-to-peer money transfers, merchant payments, and support for transactions via the Bitcoin Lightning Network.
For the purposes of providing the Service, the Developer reserves the right to utilize third parties unaffiliated with the Developer for the provision, implementation, and execution of the Services described in these Particular Terms and Conditions, while ensuring that such third parties comply with the required standards of quality and confidentiality (the "External Providers").
2. The Service
The User accesses the Service through the "Deposit dollars from USA with a payment link" option available within the App. Upon entering the amount to be collected, the system generates a payment link that the User must share with the person from whom they wish to receive the funds (the "Payer").
The Payer, who must have an active Cash App account, opens the link and makes the payment via the Lightning Network. The User automatically receives the amount in USDC in their belo Account.
Payment links have a fixed amount defined by the User at the time of creation. The links do not have an expiration date and can be reused multiple times, allowing them to be used by different Payers independently. The User may create as many links as they wish, each with its own specific amount.
The Developer shall not be held responsible for, nor will it verify, the reasons, amounts, or any other circumstances regarding the collection processing requests made by the User. In this sense, the Developer acts solely as a facilitator of the Service. The User acknowledges and accepts that under no circumstances shall the Developer be liable for costs arising from erroneous transfers, rejected transfers, or the incorrect use of the Service.
Furthermore, the User expressly assumes the obligation not to use the Service for illicit purposes and/or purposes other than those provided herein. If the Developer suspects or finds evidence that the App and/or the Service is being used for any activity prohibited by law or the General Terms and Conditions, it may reject, cancel, or suspend a collection processing request, and/or temporarily block the User's access and use, and/or the availability of features, and/or permanently cancel the User's belo Account.
3. Costs
The User irrevocably accepts, acknowledges, and authorizes the Developer to perform the withholding or collection of any tax, fee, charge, or concept that must be withheld or collected in accordance with the transaction carried out by the User or pursuant to any other provision established by applicable regulation. The User is solely responsible for all matters concerning taxes applicable to transactions conducted through the App; therefore, neither the Developer nor its affiliates, linked companies, directors, managers, employees, agents, representatives, or proxies shall be held liable for the User's tax obligations before the competent authorities.
4. Limits and Minimum/Maximum Amounts for Service Use
It is hereby stated that the use of the Service may be subject to minimum and maximum amounts, as well as sending limits, imposed exclusively by External Providers unaffiliated with the Developer. The User acknowledges that these restrictions are external and affect only the Payer; therefore, they do not imply any credit limits on the part of the Developer nor do they restrict the User's ability to continue using the Service. Consequently, the Developer assumes no responsibility if a transaction cannot be completed due to operational or regulatory limits, or the availability of funds from the Payers as determined by the External Providers.
5. Independence
Both the Developer and the External Providers used to provide the Service are independent companies. The Developer is a mere facilitator of the Service. The User acknowledges and accepts that under no circumstances shall the Developer be liable for costs arising from erroneous transfers, rejected transfers, or the incorrect use of the Service.
6. Declarations
The User declares that they will use the Services lawfully and that their activity is not related to:
The manufacture and sale of firearms, ammunition, explosives, and other related materials;
The sale of narcotics and controlled substances;
The promotion or sale of content related to pedophilia or pornography;
Shell Banks;
Money laundering, or the trafficking of weapons, persons, animals, etc.;
Any activity or goods whose promotion or sale is contrary to legal and administrative provisions, morality, or public policy;
Content that in any way involves minors under 18 years of age, or films or photographs of minors under 18 that have been taken illegally or without the consent of the individuals appearing in them;
The promotion of violence and/or discrimination of any kind;
The promotion or sale of content, goods, or services that violate any current legislation, especially those referring to the protection of intellectual property rights and software piracy.
7. Personal Data
By accepting these Particular Terms and Conditions, the User understands and accepts that the information and personal data provided in connection with the use of the Service may be shared and/or disclosed to third parties unaffiliated with the Developer, solely for the purpose of ensuring the correct provision, implementation, and execution of the Service. The Developer commits to ensuring that such third parties comply with applicable data protection and confidentiality standards in accordance with current regulations.
8. Security and Liability
The User shall be solely responsible for the use of the Service, the collection instructions, and the movements made within their belo Account. Furthermore, the User undertakes to safeguard their access keys and not share them with third parties, exercising the utmost diligence and care. The User understands that in the event of loss, vulnerability, theft, and/or leakage of account access information, the User is exclusively responsible for any losses and damages that this may cause, holding the Developer and its External Providers harmless from any claims regarding such damages.
9. Modifications
All requests, inquiries, claims, and, in general, any communication to the Developer must be sent to the Help Center indicated in the App or to [email protected]. The Developer reserves the right to modify, alter, or update these Particular Terms and Conditions at any time, as well as to modify any content included in the services offered through the App, thereby applying the provisions set forth in the "Modification of the General Terms and Conditions" section of the General Terms and Conditions.
