The following are the particular terms and conditions (the “Particular Terms and Conditions”) that govern the service called “Get Paid with Pix”, which allows the belo User to make payments to third parties that operate with the Pix system, which must be read, understood and accepted by those who use the service provided (the “Service”).

Acceptance

By accepting the Particular Terms and Conditions, you agree to comply with each of the Particular Terms and Conditions, the General Terms and Conditions and Privacy Policy prior to using the Service.

THE USE OF THE SERVICES IMPLIES SUFFICIENT PROOF OF ACCEPTANCE BY THE USER OF THESE GENERAL TERMS, THE PRIVACY POLICY AND THE OTHER DOCUMENTS THAT REGULATE THE PRODUCTS AND SERVICES OFFERED TO USERS.

Any User who does not wish to accept these Terms of Use must refrain from using the Service.

1. What is Pix?

Pix is a Brazilian instant payment system (SPI). The payment method was created by Banco Central Do Brasil (BACEN) and allows you to transfer R$ between accounts in a few seconds, at any time of the day. It is practical, fast and secure. Your transfers are irreversible. Pix transfers can be made from a current account, savings account or Brazilian prepaid account.

The main characteristics of the system are its availability 24 hours a day, 7 days a week, 365 days a year, the speed of transactions which are almost instantaneous, the convenience of payment possibilities through technologies such as the QR Code, the security, the multiplicity of use cases and possibilities, the aggregated information, the greater competition it allows among financial entities, in addition to the replenishment and savings it offers compared to existing payment methods.

For the purpose of providing the Service, the Developer reserves the right to use third parties outside the Developer for the provision, implementation and execution of the Services described in these Particular Terms and Conditions, always ensuring that such third parties comply with the required standards of quality and confidentiality.

2. Service

The User accesses the Service by clicking on the “Get paid with Pix” button. When entering the amount to be charged, the system generates a QR code or a payment link that the User must share with the person he/she wants to charge (the “Payer”).

The User receives the amount, minus the applied commission, in USDT, in his/her belo Account.

QR codes can be fixed or dynamic. The amount can be preset by the collector or defined by the Payer of the product or service. QRs respect the EMVCo standard.

The Developer shall not be responsible for or verify the causes, amount or any other circumstances relating to the request for payment processing or collection, as well as regarding the existence, quality, quantity, performance, condition, integrity or legitimacy of the goods or services offered, purchased or disposed of by the Users and paid for using the Application.

The User assumes the obligation not to use it for illicit purposes and/or other than those foreseen herein. If the Developer considers that there is a suspicion or indication of the use of the Application and/or the Service for any activity prohibited by law or the General Terms and Conditions, it may refuse, cancel or suspend a request for payment processing or charging, and/or temporarily block the User's access and use and/or the use or availability of functionalities and/or definitively cancel the User's belo Account.

3. Fees

A commission is applied to the transactions made using the Service, which will be informed in the Application, and will be automatically deducted from the amount to be credited to the account.

The User accepts, acknowledges and irrevocably authorizes the Developer to withhold or collect any tax, fee, charge or concept that should be withheld or collected according to the operation performed by the User or according to any other provision established by the applicable regulation and in the percentages or with the exceptions resulting therefrom. It is the responsibility of the User all matters concerning the taxes applicable to the transactions made through the Application, so neither the Developer nor its affiliated or related companies, directors, managers, employees, agents, representatives and attorneys-in-fact, shall be liable for the tax obligations of the User before the competent authorities.

4. Limits

The Service will be enabled for transactions with a minimum and maximum amount, according to the limits informed in the App.

The approval of transactions is subject to verification of operational limits established by the operators, payment institutions involved, regulatory bodies, availability and sufficiency of funds of the Payer. In all cases, belo shall have no liability if it is not possible to make payment for a good or a service due to issues related to the assumptions listed in this paragraph.

5. Crediting times

The User accepts that there may be exceptional delays in the processing of transactions linked to the clearing time of the same, so there may be delays in the crediting of funds in the Belo Account, not attributable to belo.

6. Consent

By accepting these Particular Terms and Conditions, the User consents to receive all payments made by the Payer, converted into USDT.

7. Declarations

The User declares that he/she will use the Services in a lawful manner and that his/her activity is not related to: (i) the manufacture and commercialization of firearms, ammunition, explosives and other related materials; (ii) commercialization of narcotics and narcotics; (iii) promotion or commercialization of content related to pedophilia or pornography; (iv) shell banks; (v) money laundering, arms trafficking, human trafficking, animal trafficking, etc. (vi) any activity or goods whose promotion or commercialization is contrary to legal and administrative provisions, morality and good customs; (vii) contents that in any way involve minors under 18 years of age, or are films or photographs that have been taken illegally from minors under 18 years of age or without the consent of the persons appearing in them; (viii) promotion of violence and/or discrimination of any kind; (ix) promotion or commercialization of contents, goods or services that violate any legislation in force, especially those referring to the protection of intellectual property rights, software piracy.

8. Personal Data

By accepting these Particular Terms and Conditions, the User understands and agrees that the information and personal data provided in connection with the use of the Service may be shared and/or disclosed to third parties outside the Developer, solely for the purpose of ensuring the proper provision, implementation and execution of the Service. The Developer undertakes that such third parties will comply with the applicable standards of data protection and confidentiality in accordance with the applicable regulations.

9. Security and Liability

The registered User will be the only responsible for the use of the Service, the instructions of collection and payment and movements that he/she makes in the accounts of his/her ownership. Likewise, the User undertakes to keep the passwords and not to share them with third parties and to take the utmost diligence and care since he/she understands that in case of loss, vulnerability, theft and/or filtration of the access information to his/her account, it is exclusively the User who will be responsible for the losses and damages that this may cause him/her, holding harmless the Developer and its External Suppliers from any claim referred to such damages.

10. Modifications

Any request, query, complaint and, in general, any communication to the Developer must be sent to the Help Center indicated in the app or to [email protected]. The Developer reserves the right to modify, alter or update these Particular Terms and Conditions at any time, as well as to modify any content included in the services offered through the app, applying, therefore, what is established in the section “Modification of the General Terms and Conditions” of the General Terms and Conditions.
