These are the Terms and Conditions applicable to the QR Payment Service.

SPECIFIC TERMS AND CONDITIONS – QR PAYMENTS

Below are the specific terms and conditions governing the service integrated into the App known as “QR Payments” (the “Specific Terms and Conditions” and the “Service”), which allows the User of belo to make payments to third parties by scanning an interoperable QR Code—whether through the PIX System or by traditional means.

QR is understood as the Quick Response Code, a module for storing information in a data matrix or two-dimensional barcode that complies with the interoperability rules established by the applicable regulations.

These Specific Terms and Conditions form part of the General Terms of Service and the Privacy Policy, which are binding and mandatory. The User declares to have read and accepted them before using the Service. All capitalized terms not defined herein shall have the meanings assigned in the General Terms of Service.

Any User who does not wish to accept these Specific Terms and Conditions must refrain from using the Service.

1. FUNCTIONALITY

The Service allows Users to make payments by scanning a QR Code in the jurisdictions enabled as indicated in the App, 24 hours a day, 7 days a week, 365 days a year (each payment, a “Payment Processing Request”). QR Codes may be static or dynamic. The amount of the Payment Processing Request may be preset by the payee or defined by the paying User of the product or service.

To provide the Service, the Developer reserves the right to rely on third parties unrelated to the Developer for the provision, implementation, and execution of the Services described in these Specific Terms and Conditions, ensuring that such third parties meet the required standards of quality and confidentiality and comply with applicable regulations in each jurisdiction (the “Third-Party Providers”). By accepting these Specific Terms and Conditions, the User authorizes the Developer to provide the necessary data to its Third-Party Providers exclusively for the purpose of executing transactions—such as, but not limited to—transfers and payments in commercial establishments using the Service.

2. SERVICE

The User must select the option to pay with QR Code and scan it so that the payment is processed and debited from their belo Account, in accordance with the procedure established in the App. For each Payment Processing Request, the Appl will automatically suggest a currency among those available in the User's belo Account that covers the required amount. The User may change this currency and choose another with sufficient balance to complete the Payment Processing Request.

If the currency selected by the User differs from the legal tender indicated in the Payment Processing Request, the applicable exchange rate will be informed before confirming the transaction, and the corresponding conversion (swap) will be carried out at the time of executing the transaction. The User may view all currencies with an available balance in their belo Account to settle a Payment Processing Request. In all cases, the User may select only one currency (i.e., one single balance) to make the payment.

If the User does not have sufficient funds required for the Payment Processing Request, the transaction cannot be executed, and the User will be informed of the reason for the failed transaction, without any liability on the part of the Developer and/or its Third-Party Providers, who shall be held harmless from any claim and/or damage arising from the lack of sufficient funds in the User’s belo Account.

If sufficient funds are available, the corresponding amount (including any applicable conversion) will be deducted from the User’s belo Account balance, based on the selected currency. The Payee will receive the amount in the legal tender indicated in the Payment Processing Request.

In the event of a refund for a Payment Processing Request, the User will receive the reimbursement in their belo Account according to the following conditions, based on the origin of the QR Code and the User’s nationality or jurisdiction:

  • If the payment was made using a QR Code generated in Argentina by a User residing in Argentina, the refund will be made in Argentine pesos (ARS).

  • If the payment was made using a QR Code generated in Argentina by a User not residing in Argentina, the refund will be made in stable digital currency (USDT).

  • If the payment was made using a QR Code generated outside Argentina (including but not limited to Brazil), the refund will be made in stable digital currency (USDT), regardless of the User’s jurisdiction.

The refund amount will be equivalent to the amount effectively transferred to the Payee in the applicable legal tender and may be subject to fluctuations due to the exchange rate at the time of the refund, applicable fees, or market conditions.

This process may vary without prior notice.

3. LIMITS

The Service will be available for transactions within a minimum and maximum amount, according to the limits indicated in the App.

The approval of each Payment Processing Request is subject to operational limits set by the operators, payment institutions involved, regulatory bodies, and the User’s availability of sufficient funds. In all cases, the Developer shall have no responsibility if a Payment Processing Request cannot be executed due to the scenarios outlined in this section.

The User acknowledges that inconsistencies in the processing of Payment Processing Requests may exceptionally occur due to settlement times, which may cause delays in the crediting of funds in the belo Account, for which the Developer shall not be held responsible.

4. FEES

Use of the Service may be subject to fees. If applicable, these will be indicated in the App.

In the case of a fee, the User irrevocably accepts, acknowledges, and authorizes the Developer to withhold or collect any taxes, duties, charges, or similar obligations applicable to the transaction or required by regulation, including the applicable percentages or exemptions. The User is solely responsible for taxes arising from operations conducted through the App. Therefore, neither the Developer nor its affiliates, officers, directors, employees, agents, or representatives will be liable for the User’s tax obligations before the relevant authorities.

5. REPRESENTATIONS

The User represents that they will use the Service lawfully and that their activity is not related to: (i) the manufacture and sale of firearms, ammunition, explosives, and related materials; (ii) the sale of narcotics and illegal drugs; (iii) promotion or sale of content related to pedophilia or pornography; (iv) shell banks; (v) money laundering, arms trafficking, human trafficking, wildlife trafficking, etc.; (vi) any activity or goods whose promotion or sale is contrary to legal and administrative regulations, public morals, and good customs; (vii) content involving minors under 18 in any way or films/photos taken illegally or without consent; (viii) promotion of violence and/or discrimination of any kind; (ix) promotion or sale of content, goods, or services that violate any current legislation, especially intellectual property and software piracy laws.

6. PERSONAL DATA

By accepting these Specific Terms and Conditions, the User understands and agrees that the personal data provided will be processed solely to fulfill the obligations under these Specific Terms and Conditions in relation to the use of the Service, and may be shared with Third-Party Providers only to ensure proper provision, implementation, and execution of the Service. The Developer commits to ensuring that these third parties comply with applicable data protection and confidentiality regulations.

7. LIABILITY

Users are solely responsible for their use of the Service, each Payment Processing Request, and any deductions, including resulting damages.

The User acknowledges and agrees that the correct reading of a QR Code may depend on factors beyond the Developer’s control (such as lighting, camera functionality, phone battery, internet connection, biometric data capture, etc.). Therefore, the Developer and/or its Third-Party Providers shall not be held liable for misreading or inability to read a QR code, interrupted or failed QR payments, or any technical issues preventing QR payments.

The Developer is not responsible for and does not verify the reasons, amounts, or any other circumstances related to a Payment Processing Request, including the existence, quality, quantity, functioning, condition, integrity, or legitimacy of goods or services paid for through the App. The Developer reserves the right to reject, cancel, or suspend a Payment Processing Request and/or block access to a belo Account temporarily or permanently in cases of suspected or detected unlawful activity or violation of the General Terms of Service.

The User understands and agrees that neither the Developer nor its Third-Party Providers shall be liable for any operations carried out by the User that are fraudulent, accidental, or due to the User’s negligence in safeguarding their access credentials or passwords. Therefore, the User assumes full responsibility for any losses or deductions from their belo Account made under their username.

8. AMENDMENTS

All requests, inquiries, complaints, and communications to the Developer must be submitted via the Help Center indicated in the App or via email to [email protected]. The Developer reserves the right to modify, amend, or update these Specific Terms and Conditions at any time, as well as to change any content included in the services offered through the App. Consequently, the section “Modification of the General Terms and Conditions” of the General Terms of Service.
