PARTICULAR TERMS AND CONDITIONS – PAYMENT ALIAS FOR NON-ARGENTINE USERS

Below are set out the particular terms and conditions (the "Particular Terms and Conditions") governing the service called "Alias for Non-Argentine Users", through which the User may transfer funds from their belo Account to an Alias associated with a Uniform Bank Code (the "Alias" and/or the "CBU", as applicable) / Uniform Virtual Code ("CVU") linked to a bank account or virtual wallet in the Argentine Republic, without the need to hold their own CVU in Argentine Pesos (the "Service".)

Acceptance

By accepting the Particular Terms and Conditions, you agree to comply with each of the Particular Terms and Conditions, the General Terms and Conditions (the "General Terms and Conditions") of the Application, and the Privacy Policy, prior to using the Service. All capitalized terms not defined herein shall have the meaning assigned to them in the General Terms and Conditions.

USE OF THE SERVICE CONSTITUTES SUFFICIENT PROOF OF THE USER’S ACCEPTANCE OF THESE PARTICULAR TERMS AND CONDITIONS, THE GENERAL TERMS AND CONDITIONS, THE PRIVACY POLICY, AND THE OTHER DOCUMENTS GOVERNING THE PRODUCTS AND SERVICES OFFERED TO USERS.

Any User who does not wish to accept these Particular Terms and Conditions must refrain from using the Service.

1. External Providers

For purposes of providing the Service, the Developer reserves the right to engage third parties unrelated to the Developer for the provision, implementation, and execution of the Services described in these Particular Terms and Conditions (the "External Providers"), always ensuring that such External Providers meet the required quality and confidentiality standards and comply with the regulations applicable to the Service.

The Developer may modify, replace, or add different External Providers at any time, without such action requiring prior notice or affecting the validity of these Particular Terms and Conditions.

2. The Service

The Service allows a User who is not a resident of the Argentine Republic, regardless of nationality, residence, or domicile, to enter the Alias/CBU/CVU of a recipient in the Argentine Republic and the amount they wish to transfer. Prior to confirming the transaction, the Application will inform the User of the exchange rate applicable to the transaction, which is determined by the relevant External Provider and may vary according to market conditions in effect at the time of execution.

Once the transaction is confirmed, the corresponding amount will be debited from the balance of the User’s belo Account, and the relevant External Provider will process the crediting of the funds, in Argentine Pesos, to the bank account or virtual wallet associated with the CBU/CVU alias indicated by the User.

The User acknowledges and agrees that the Developer acts exclusively as a facilitator to channel the transfer instruction to the relevant External Provider, and is not a party to the underlying payment relationship between the User and the recipient. The Developer shall not be responsible for, nor shall it verify, the reasons, origin, destination, or any other circumstance relating to the transfer instructed by the User. The User is solely responsible for verifying the accuracy of the recipient’s details prior to confirming the transaction.

3. Fees

Use of the Service may be subject to fees. If applicable, such fees will be disclosed to the User in the Application prior to confirmation of each transaction.

If a fee applies, the User accepts, acknowledges, and irrevocably authorizes the Developer to withhold or collect any tax, duty, charge, or amount that must be withheld or collected in connection with the transaction carried out by the User, or pursuant to any other provision established by applicable regulations, at the rates or subject to the exemptions arising therefrom. The User is solely responsible for all tax matters applicable to the transactions carried out through the Application, and neither the Developer nor its affiliated or related companies, directors, officers, employees, agents, representatives, and attorneys-in-fact shall be liable for the User’s tax obligations to the relevant authorities.

4. Minimum and Maximum Amounts and Limits

Please note that use of the Service may be subject to minimum and maximum amounts and other operational limits, which will be duly disclosed to the User in the Application and/or imposed by the External Providers, the payment operators and institutions involved, and the applicable regulatory bodies.

The User acknowledges that such restrictions may be imposed exclusively by the External Providers and may be outside the Developer’s control, and that the Developer shall bear no liability if a transaction cannot be completed for reasons related to operational or regulatory limits, or the availability of funds.

5. Reversals and Delays

The User agrees that delays may exceptionally occur in crediting funds to the recipient’s bank account or virtual wallet, related to the settlement time of the relevant External Provider, which are not attributable to the Developer.

In the event of a reversal of funds relating to a transfer, the User will receive a refund into their belo Account for an amount equivalent to the amount actually debited, which amount may be subject to variation based on the exchange rate in effect at the time of the reversal, applicable fees, or market conditions. The process described herein may change without prior notice.

6. Independence

Both the Developer and the External Providers used to provide the Service are independent companies from one another. The Developer is a mere facilitator of the Service and does not guarantee or verify the outcome of the transaction once the instruction has been transmitted to the relevant External Provider. The User acknowledges and agrees that under no circumstance shall the Developer be liable for costs arising from erroneous transfers, rejected transfers, or improper use of the Service.

7. Representations

The User represents that they will use the Service lawfully and that their activity is not related to:

  • the manufacture and sale of firearms, ammunition, explosives, and other related materials;

  • the sale of narcotics and controlled substances;

  • the promotion or sale of content related to pedophilia or pornography;

  • shell banks;

  • money laundering, trafficking in weapons, persons, animals, etc.;

  • any activity or goods whose promotion or sale is contrary to legal and administrative provisions, morals, or good customs;

  • content that in any way involves minors under 18 years of age, or films or photographs that were illegally taken of minors under 18 years of age or without the consent of the persons depicted therein;

  • the promotion of violence and/or discrimination of any kind;

  • the promotion or sale of content, goods, or services that violate any applicable law, in particular those relating to the protection of intellectual property rights and software piracy.

8. Personal Data

By accepting these Particular Terms and Conditions, the User understands and agrees that the information and personal data provided in connection with the use of the Service may be shared and/or disclosed to the External Providers, solely for the purpose of ensuring the proper provision, implementation, and execution of the Service. The Developer undertakes that such External Providers will comply with the applicable data protection and confidentiality standards under current regulations.

9. Security and Liability

The User shall be solely responsible for the use of the Service, the transfer instructions, and the movements carried out in their belo Account, including the accuracy of the CBU/CVU alias provided. The User further undertakes to safeguard their access credentials and not to share them with third parties, and to act with the utmost diligence and care, acknowledging that in the event of loss, compromise, theft, and/or leakage of their access credentials, they shall be solely liable for any losses and damages that may result therefrom, holding the Developer and the External Providers harmless from any claim related to such damages.

If the Developer believes there is suspicion or indication that the Service is being used for any activity prohibited by law or by the General Terms and Conditions, it may reject, cancel, or suspend a transfer, and/or temporarily or permanently block access to and use of the User’s belo Account.

10. Amendments

Any request, inquiry, claim, and, in general, any communication to the Developer must be submitted to the Help Center indicated in the Application. The Developer reserves the right to modify, amend, or update these Particular Terms and Conditions at any time, as well as to modify any content included in the services offered through the Application, in accordance with the provisions set forth in the "Modification of the General Terms and Conditions" section of the General Terms and Conditions.
